Terms of Use and Preliminary Design Disclaimer
FrameScope™, a division of All Points Technical Inc. ("FrameScope™", "we"). Effective [DATE]. These terms apply to every FrameScope™ package, takeoff and output, however ordered: the FrameScope™ website or the FrameScope™ connector in Claude.ai. These terms are a contract between the customer and All Points Technical Inc., a Delaware corporation, which is the sole provider of FrameScope™ services and the only party to these terms.
Preliminary output notice (on each sheet and export)
1. Preliminary Design Disclaimer
- Standard FrameScope™ output (Standard level) is created and generated by the APAS Vision™ Engine, an automated artificial intelligence system, without individual technician review. A FrameScope™ technician reviews the project only when the Pro option is purchased.
- FrameScope™ packages are preliminary design and concept-planning documents prepared to help estimate the size, quantity, board footage and weight of trusses, wall panels and framing materials.
- They are not final designs, shop drawings, sealed truss designs or engineered drawings, and must not be used for permit, fabrication, ordering without verification, or construction.
- Final truss designs must be sealed by a registered design professional licensed in the project's jurisdiction, either through the FrameScope™ sealed design upgrade (section 2A) or by the truss manufacturer's designer and the plate company's or manufacturer's registered design professional.
- Final wall panel designs, headers, hold-downs, shear walls, lateral systems and foundations are by the project's Engineer of Record and the panel manufacturer.
- Loads, spans, member sizes, grades, combined stress index (CSI) values, deflections, reactions and connections shown are preliminary estimates and may change in final design.
- Design values are based on the inputs and plans provided and on assumed code editions, loads and site conditions that must be confirmed by the Engineer of Record and the building official.
- Requests for information (RFIs) listed in the package identify open items; the package is incomplete until they are resolved by the responsible parties.
- FrameScope™ packages do not include bracing design. Temporary and permanent bracing are required per BCSI and the final truss design.
2. No engineering services; no professional relationship
Base FrameScope™ packages (Standard and Pro) are not professional engineering services. FrameScope™ does not act as Engineer of Record for any project, and no engineer's seal is applied to a base package. Use of a base package creates no professional engineer–client relationship. Where a jurisdiction restricts preliminary structural information to licensed professionals, the customer is responsible for engaging one.
2A. Sealed design upgrade
A full truss project designed by a FrameScope™ truss technician, with sealed truss drawings, is available as a separate service through Solutions 4 Design (s4dz.com). It is quoted per project after plan review and is governed by a separate written engagement that sets its scope, deliverables, schedule, fees and liability. The sealing design professional is arranged project by project. The preliminary output notice and sections 1 and 2 do not apply to drawings issued under that engagement.
3. Customer responsibilities
The customer is responsible for the accuracy and completeness of the plans, dimensions, loads, site information and scope selections provided. FrameScope™ relies on that information without independent verification. The customer confirms it has the right to upload and use the plans and documents it provides, including any architect's or engineer's drawings, and will indemnify All Points Technical Inc. against claims that an upload infringes another party's rights. The customer must review every package, resolve every RFI and have all information verified by qualified professionals before relying on it.
4. Truss-to-truss hangers and uplift connections
Truss-to-truss hanger selections are included in truss design packages; uplift tie-down selections are provided only when the uplift add-on is purchased. Both are preliminary, based on estimated reactions and the connector manufacturer's published values at the time of preparation. They must be confirmed against the final sealed truss design, the Engineer of Record's requirements and the manufacturer's current published load tables and installation instructions. Naming a connector brand implies no endorsement by or affiliation with that manufacturer.
5. Estimate and takeoff notice
Quantities, board footage, weights and any prices in a FrameScope™ takeoff are preliminary estimates for budgeting. They are not a firm price quote, bid or order list. Verify every quantity, size and grade before ordering. FrameScope™ is not responsible for over-ordering, under-ordering, price changes or delays arising from use of an estimate.
6. No warranty
FrameScope™ and all outputs are provided "as is." To the fullest extent permitted by law, FrameScope™ disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, code compliance and non-infringement.
7. Limitation of liability
To the fullest extent permitted by law, the total liability of All Points Technical Inc. and its officers, employees and contractors for all claims arising from a project is limited to the fee the customer paid for that project.
Design assumptions. FrameScope™ design analysis assumes proper soil conditions at the site, including adequate bearing for foundations and supports. All building codes and code editions, wind speeds, snow, seismic and other loads, and any other design criteria are assumed for preliminary purposes and are subject to review and approval by the supervising design professional or Engineer of Record (EOR) for the project being considered. All Points Technical Inc. is not liable for site conditions, codes or design criteria that differ from these assumptions.
In no event will All Points Technical Inc. or its officers, employees and contractors be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, delay, rework, material costs or construction defects, even if advised of the possibility.
Any claim must be brought within sixty (60) days after the package is released.
8. Indemnification
The customer will defend, indemnify and hold harmless All Points Technical Inc. and its officers, employees and contractors from claims, losses and expenses (including reasonable attorneys' fees) arising from the customer's or any third party's use of a FrameScope™ package contrary to these terms, including use for permit, fabrication or construction.
9. Payment and release
Each project is priced and paid in advance through Stripe. Quoted prices are for standard residential and light commercial projects; if review finds a large or complex project, the customer is notified before work starts and any revised price requires the customer's approval. FrameScope™ uses USA design codes and criteria; other countries and metric formats are by request. A package is released only after payment clears and the customer has accepted these terms at checkout. Refunds: [REFUND POLICY]. Revisions within the original scope: [REVISION POLICY]. Block pricing or subscription terms, where offered, are set in a separate written agreement. Live chat and email messages are not a quote, design approval or order.
10. Intellectual property
The All Points Technical™ name and brand, FrameScope™, APAS™, APAS Vision™, the software, engine and output formats are the intellectual property of All Points Group S.A., licensed to All Points Technical Inc. This license does not make All Points Group S.A. a party to any FrameScope™ order, and section 7 (Limitation of liability) is unchanged. The customer receives a non-exclusive license to use a purchased package for the named project only. No resale, redistribution, reverse engineering or use to train or build competing tools.
11. Third parties
Packages are prepared for the purchasing customer only; no third party may rely on them. When the customer shares a package with a dealer, plant or contractor, these terms travel with it. Orders placed through the FrameScope™ connector in Claude.ai are governed by these terms; the platform provider is not a party to them and is not responsible for FrameScope™ outputs.
12. Governing law and disputes
These terms are governed by the laws of the State of Florida, USA. Disputes will be resolved exclusively in the state and federal courts serving Bay County, Florida, USA, and the customer consents to their jurisdiction. If any provision is unenforceable, the rest remain in effect.
